A Story for the ages: The importance of having good professionals in your Real Estate transaction

This transaction speaks volumes about why you need a good team on your side when #buying or #selling #realestate. Let me tell you the story, which is something that happened to me for the first time in my 31 years of practicing real estate in #NewYorkCity. In October of 2023 I represented Mr. Fernández as a #buyerbroker in going into contract for a great deal, a #2familyhouse in #EastElmhurst which needed work and was competitively priced, what is called a #handymanspecial . By structuring an offer with terms and conditions appealing to the seller, we were able to beat all the competing #multipleoffers. We were preapproved, ready to go, willing to buy in #asiscondition, including the physical condition and an open application from Department of Buildings. We were also willing to accommodate the seller as to the closing date. We were purchasing the home vacant (seller lived on the first floor and there was a tenant on the 2nd floor, relative to the seller). Our #realestateattorney was Chris Psomopoulos and our mortgage was being done by Mario Villamil from the Interstate Home Loan Center. We did our #appraisal, and got our #mortgagecommitment before the required 45 days. We were soon ready to close. Unfortunately the tenant who needed to move out could not find a place and did not have the means to pay for relocation. The seller, and elderly gentleman, could not assist either, financially or otherwise. Mr. Fernández offered to pay for the tenant relocation and in this way, the 2nd floor unit became vacant. We are talking now, Spring of 2024. We updated our mortgage commitment and when we were ready to close, with #cleantitle, the seller unfortunately became ill and passed away. The out of state seller heirs, which at this point could cancel the deal, stated their desire to honor the contract and close with Mr. Fernández. There was a #will that had to be probated. The #interestrates were going up but so were real estate prices in #EastElmhurst. Mr. Fernández looked at the big picture and decided to continue with the transaction. The will was approved by #ProbateCourt and one of the seller´s son named executor in November of 2024. By now, with the house vacant and no rental income, the seller´s mortgage holder was threatening #foreclosure and filed a #lispendens. Mr. Fernández quickly applied for the #mortgage, the second appraisal was done asap and he got approved. Our attorney Chris Psomopoulos law offices of Law Office of Chris Psomopoulos worked diligently with the seller´s attorney, Anthony Russo, and we obtained the green light from the seller´s lender to agree to the sale and stop the foreclosure.
